Welcome to COLUSI Gamer! References to "we", "us" and "our" refer to COLUSI Gamer. COLUSI Gamer operates this store and website, including all relevant information, content, features, tools, products and services relating to orders, to deliver a tailored shopping experience to you (the customer), hereinafter referred to as the "Services". An order shall only be deemed confirmed and accepted by COLUSI Gamer after we receive and process your payment. Please check your order carefully before submission. Once an order is accepted, COLUSI Gamer may not accommodate order cancellation requests. If we decline, modify or cancel your order, we will attempt to contact you via the email address, billing address and/or phone number you provided at checkout.

Returns and exchanges for your purchases shall be governed exclusively by our Refund Policy.

You represent and warrant that all purchases made by you are for personal or household use only, and shall not be used for commercial resale or export.

We shall not be liable for any shipping or delivery delays. All delivery times are estimates only and not guaranteed. We assume no responsibility for delays caused by carriers, customs clearance or circumstances beyond our control. Title to the products and the risk of loss shall pass to you once we hand over the products to the carrier.

COLUSI Gamer is powered by Shopify to provide you with the Services. However, all sales and purchases made at our store are transacted directly between you and COLUSI Gamer. By using the Services, you acknowledge and agree that Shopify shall not be liable for any aspect of transactions between you and COLUSI Gamer, including any injuries, damages or losses arising from the purchase of products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising out of or in connection with your purchases and dealings with COLUSI Gamer.

(2) Not conceal or disguise the fact that access or interaction is made by an Agent, including (a) simulating human behaviors and interaction patterns, or (b) completing or bypassing CAPTCHA and other human verification mechanisms;

(3) Answer truthfully any questions or prompts designed to distinguish human users from automated systems;

(4) Not evade or circumvent any measures implemented to prevent, restrict, modify or control Agents’ access to and use of the Services.

We may terminate this Agreement or your access to the Services (or any part thereof) at any time at our sole discretion without prior notice. You shall remain liable for all outstanding payments accrued up to and including the termination date.

Upon termination of these Terms, the following sections shall remain valid and enforceable: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and all other provisions which by their nature shall survive termination.

Your reliance on any such information shall be entirely at your own risk. To the fullest extent permitted by applicable law, COLUSI Gamer, its partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors, together with Shopify and its affiliates, shall not be liable for any injuries, losses, claims, or any direct, indirect, incidental, punitive, special or consequential damages of any kind. This includes but is not limited to lost profits, lost revenue, lost savings, data loss, replacement costs and other similar damages, regardless of whether such claims are based on contract, tort (including negligence), strict liability or other legal grounds. This limitation applies to all losses arising from your use of the Services or products obtained through the Services, including errors or omissions in content, or any losses caused by content or products published, transmitted or otherwise provided via the Services, even if we have been advised of the possibility of such damages.

You agree to indemnify, defend and hold harmless COLUSI Gamer, Shopify, our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from and against all losses, damages, liabilities, claims and expenses (including reasonable attorney fees) arising from: (1) your breach of these Terms of Service or any documents incorporated herein by reference; (2) your violation of applicable laws or third-party rights; or (3) your access to and use of the Services.

We will notify you of any indemnification claims, but failure to receive timely notice shall not relieve you of your indemnification obligations, unless you suffer substantial prejudice as a result. We may take charge of the defense and settlement of such claims at your expense, including the selection of legal counsel. We shall not settle any claim requiring you to assume non-monetary obligations without your consent, and you shall not unreasonably withhold such consent. You shall fully cooperate in the defense of indemnification claims and provide relevant documents upon request.

These Terms of Service, together with all policies and operating rules posted on our website or relating to the Services, constitute the entire agreement and understanding between you and us governing your use of the Services. They supersede all prior or contemporaneous oral and written agreements, communications and proposals between the parties, including all previous versions of these Terms. No ambiguity in the interpretation of these Terms shall be construed against the drafting party.

You may not delegate, transfer or assign this Agreement or any of your rights and obligations hereunder without our prior written consent, and any attempted assignment shall be null and void. These Terms of Service shall be governed by and construed in accordance with the laws of Hong Kong, excluding its conflict of law rules. All disputes arising out of or relating to these Terms shall be resolved exclusively by the courts of Hong Kong.

Headings used in this Agreement are for convenience only and shall not limit or affect the interpretation of these Terms in any way.
